Judge in Rod Blagojevich Trial Rejects Latest Mistrial Motion

U.S. District Judge James Zagel took a break in testimony to deliver a long monologue explaining why he was rejecting a new defense motion for mistrial that alleged a grab bag of erroneous rulings by the judge.

Specifically, Blagojevich’s lawyers claimed that Zagel has erred in frequently shooting down their objections to questions from prosecutors while also blocking defense attempts to attack the fairness of a 2005 interrogation of Blagojevich by government agents.

Zagel chided defense lawyers for suggesting in their motion that the agents were under some obligation to disclose to Blagojevich all the evidence of illegal activity they were investigating when they questioned him.
